Salt Lake City, Utah. Attorney Frank Mylar filed an amicus brief for American Leadership Fund and Historians at the U.S. Supreme Court in defense of Utah’s Marriage law. He issued this statement today:

“Regardless of one’s position on the definition of marriage, it is not an overstatement that the recent decisions by lower courts, declaring unconstitutional state constitutional provisions that define marriage as one man and one woman, is a radical departure from prior decisions of just a few years ago. Changing a societal norm, such as the definition of marriage, that has existed since before recorded history, by means of judicial decisions, is a matter of great concern to this country and a matter worthy of timely review by this Court. We’ve been contacting the governor, the legislature, and other elected officials. This is a sad state we are in, pun intended.

Utah has no support from its Governor to defend its marriage law. He has taken precisely the wrong action to weaken our case before the 10th Circuit by ordering the Counties to comply with an unconstitutional judicial ruling and one that forces County Clerks to break state law by issuing illegal marriage licenses to same sex couples. Emotions are running high after the unexpected ruling by District Court Judge Robert Shelby declaring Utah’s Marriage Amendment 3 is unconstitutional. Many are making claims that have no basis, and I have promised to provide the research I have. First, let me address the basic assertion of pro-gay marriage supporters: that it has no impact on anyone nor on heterosexual marriage. My friend Brian Cammeker has compiled a comprehensive list of specifics that have occurred in Massachusetts, the first state to legalize same-sex marriage in 2004. Federal Court Declares Utah’s Marriage Amendment Unconstitutional

It seems the Obama Administration likes to use the Friday before Christmas to deliver his “lovely” Christmas presents to us.

Remember 2010?  Yes, it was ObamaCare wrapped up in a glittering, beautifully-wrapped package all tied up with a pretty bow.

Well, now that bow has unraveled and what’s inside is not so glittering, beautiful or pretty.

Today, again the Friday before Christmas, Utahns received their “Christmas” present from the Obama Administration:  An Obama-appointed Federal district judge named Robert Shelby single-handedly declared that Utah’s Amendment 3 is unconstitutional in a 53-page opinion.

In that opinion he also proclaimed that the will of the people is irrelevant.  He said so.

This is judicial activism in its “finest” hour.

The Attorney General’s office is going to appeal and will call for a stay.

We are actively engaged in this fight, as you know, and will be at the next legislative session in 2014 where we anticipate other challenges to marriage and family.

Christmas is right around the corner. Everyone is busy, but marriage and our children are most important to the future of our society.

Utah Is Targeted to Bring the Nation Down

I don’t know about you, but I’m disgusted by the nerve, the audacity, the absolute power that our Courts, this administration and our current President believe they have. 

Utah is the number 1 targeted state in the nation for overturning constitutional amendments defining marriage between a man and a woman.

If Utah goes down, a strongly-conservative state on the marriage and family issues, the entire nation will follow.

We network with many other family issues groups at the legislature to educate our elected officials on a variety of topics.  We have assisted with major events to bring the research to elected officials and to you showing that marriage between a man and a woman is the number 1 and best protection for the well-being of children.

Marriage Is Not About Adults – It’s About Children

Marriage is not about adults wanting a pleasurable relationship.  Marriage is about children who deserve both a mom and a dad.  It’s about creating the best environment for children.

Virtually every credible study shows that children are better off in every way in a home with both a mother and father who are married.

Marital “equality” is not about civil rights. 
Judges who declare state marriage amendments unconstitutional because of “discrimination” are ignoring their own strict scrutiny standards for suspect classification, which are: it must be inborn, involuntary and immutable.

Based on these standards, gay marriage defenders have no constitutional leg upon which to stand.

Religious Liberties Undermined
We know that many businesses and individuals have been punished, fired, fined or shut down because of religious beliefs.  Companies that provide wedding photography, cakes, flowers and Catholic charities’ adoption services have been the prime targets.  Catholic Charities in some states have been shut down altogether because of their religious beliefs.

“It Won’t Affect Me – What’s the Big Deal?”
Some say that making same-sex marriage legal won’t affect them or their families. “Why not just live and let live?” they ask.

Think again.

In other states that have legalized same sex marriage, the public schools are required to teach that same sex marriage and homosexual relationships are legal and no different from marriage between a man and a woman.

Frankly, children are being taught LIES in school.  In fact, if you aren’t for “equality” you must be a bigot – or a “bully.”

If you are concerned that your children are being – or will be – indoctrinated or their religious beliefs challenged, you should be concerned about this challenge and others that Utah will face in the next legislative session.
