Socialized Medicine Upheld 6-3 US Supreme Court

Unbelievable, but it looks as though the tax subsidies will stand for those states that did not set up socialist health care state exchanges.  All Americans are now constitutionally “entitled.”

What has been ruled constitutional is that FREE options will compete with PAID options on a state insurance exchange. Good luck to the PAID options. And good luck to the taxpayers that will continue to experience spikes in their taxes and “double taxation,” if they wish to hang on to their private option.

Kudos to Scalia who barbecued Roberts’ outrageous decision and called it what it is in his strong dissent: SCOTUSCare.  To echo his sentiments, Chief Justice Roberts’ legacy is indeed hurting the Court – and Roberts’ reputation – long-term.  But I will add, it especially is hurting our young people who will bear the burden of the elderly subsidies that far outweigh their capacity to do so by sheer numbers.

Napolitano described it as a “weird” ruling declaring that Roberts has pulled his logic out of thin air and that he cannot read plain English.

I’m equally dismayed at the silence from the private options enterprises for not protesting this ruling.  But then, why would they? They believe the mandate will bring them profits, in spite of what will eventually be the inevitable: their own demise and hostile government take-over.

I urge you to connect with two groups of doctors that are speaking out:  The Association of American Physicians and Surgeons has been actively engaged in the legal fight.  Here is an excellent and brief rundown on the Court’s ruling.  AAPS sends out alerts regularly.  Read what AAPS is saying about the damage the ACA is doing and the response to the ruling, forthcoming.

Also, pay attention to what the Surgery Center of Oklahoma is doing, whose doctors are affiliated with AAPS.  If you want the truth in simple terms, to learn how ObamaCare is harming you, and to find out what the options and solutions are, read Dr. Smith’s blog.

This socialist decision is sure to follow the course of social security and Medicare – and education.  It will suck the majority of Americans into the system and the system will become mediocre, harming untold numbers of patients that will need the care but will not get it in a timely fashion, if at all.

The history is clear:  The public subsidies of social security and Medicare were originally limited to a small percent of the population, but eventually Americans behaved as children, “If little Joey gets the candy for free, I get it too!!!”  and “I’m paying taxes, so I should get this government subsidy too,” even though they don’t need it.  Everyone is entitled in a socialist society.

If insurance companies were honest and principled, they would speak up.  They would call this an unfair trade practice.

Is there a political party that believes in free enterprise any more?  Have the two major parties become Socialist and Socialist Lite?  How will Congress respond?  When will Congress apply a checks and balance to the Supreme Court that is given it in Article III of the U.S. Constitution?

A legislative response is overdue. If Congress doesn’t respond, we are indeed headed for what my doctor father said on July 31, 1965 when Medicare first passed: “This is the first day of the end of quality delivery of medicine in America.” For those who were not living in 1965, you most likely don’t miss the liberty you have never known.

Let’s hope Americans will take up the challenge to unseat every Senator that confirmed these judges. Utah’s Orrin Hatch is among them.  2016 must be a turn around.  Our future depends on it.  Drill deeply in your analysis, because most Republicans run as conservatives, but they are far from it.

Utah’s Redistribution of Wealth is Unhealthy

I received an email from a Utah conservative who wrote that he had been “in and around the legislature for a few years now” and that he’s a “strong conservative” who now works for “a very reputable online political marketing company in SLC” that works with “many high profile Republican campaigns across the country.”

He then criticized me for my position opposing Healthy Utah, Governor Gary Herbert’s plan for Medicaid Expansion.  I offered these three articles as talking points, and he objected saying that these had been written between October and December 2014, but the bill was released February 5, 2015.

Kudos to Utah’s True Republicans

I’d like to express my deep appreciation to stalwarts in the Utah Senate who understand the rule of law and the Constitution’s limited powers and who see through the facade of this waiver and who voted against its passage on the Senate floor.

They are:  Allen Christensen, Margaret Dayton, Deidre Henderson,  Al Jackson, Mark Madsen, Howard Stephenson, Steve Urquhart, and Evan Vickers.  

The bill is now in the House Rules Committee.  Please contact those members and ask them to HOLD it in rules.  Also contact your House reps and let them know you OPPOSE this legislation.

As wonderful as it may seem now, when has government ever established a “pilot” program that did not become a permanent one?  When so many become entitled and recipients of a welfare program, what then happens politically to elected officials that attempt to sunset or phase out such welfare programs?

History shows that pilot programs are not easily repealed, defunded, phased out or sunsetted because that becomes a political hot potato. Thus the United States, and in this case Utah, participates in the perpetuation of redistribution schemes that join the rest of the unsustainable programs public officials and bureaucrats are compelled to promote for re-election.

We have become a nation – and Utah is among the states in that nation – that elects the candidate that offers the most free stuff.  This is exactly what the Soviet Union became.

A Model Solution

In my testimony at the hearing I offered an alternative, private sector solution:  Drs John and Alieta Eck of the Zaraphath Health Care Center in Somerset, New Jersey.  Their program runs an annual budget of around $50,000 and costs around $13 a visit.  Meds are free.  Volunteer doctors make it happen.  They have even come together to negotiate urgent surgeries to aid the indigent.

Their congregation contributes to the clinic and the members use a “health care sharing ministries” model of covering medical costs.  It’s not insurance.  It’s better.  It’s Obamacare exempt, and it’s much less expensive.  You won’t be paying for abortions or any other procedures that will violate your religious beliefs.

Do it NOW.  Help yourself with less expense that preserves your religious beliefs, help American Leadership Fund, and help defeat Obamacare and keep Utah and the other states from promoting and helping the ACA to succeed.

Remember, there are three legs to the Obamacare stool in order for it to succeed:

1. The state exchange (DONE – in Utah)
2. Government-run HMO’s, called “ACO’s” – Accountable Care Organizations (DONE – in Utah)
3. Medicaid Expansion

The message to every state legislator is simple:  Do Not Participate in Medicaid Expansion, even if it sounds good.  The bottom line is that Republican governors WANT the federal funds they will get now, even if it goes away in the future and becomes an unfunded mandate.

Republicans that support redistribution of wealth (which is how Medicaid works) are violating basic principles of their own party’s platform and should be censured and in states where conventions endorse, those candidates should be held accountable and not receive the party’s endorsement.

Larry King hosts ObamaCare debate between two doctors

This is a great debate between Richard Amerling, nephrologist and President-Elect of the Association of American Physicians and Surgeons and George S. Benjamin, internist/ER doctor and Executive Director of the American Public Health Association.

It’s less than 15 minutes and is packed with information that we need to share with our state legislators and governors, as well as our Senators and Representatives in Congress.

The governor of Utah has not yet decided how he will deal with ObamaCare and the pressure to expand Medicaid. We’re getting ready for an upcoming legislative session in late January and as AAPS’ Utah coordinator, I will be there working hard to prevent expansion.

Love, Lee and Lack of Integrity at Deseret Digital Media

On November 14, 2013 I read a front page article  in the Deseret News on Congressional candidate Mia Love headlined “Love rejects tea party label, didn’t like tactics.” It was disparaging Utah’s Senator Mike Lee and the group of citizens that supported Mia, but it did not sound like Mia. So I texted her cautioning her not to lose her anchor and to stay true to who she is. She immediately called back and expressed her displeasure with the false coverage.

How to Beat ObamaCare

I represent the Association of American Physicians and Surgeons in Utah at the legislature. One of the hallmarks of that association, aside from the fact that it was the organization that exposed the closed doors talks for HillaryCare and defeated it, and that it was the only doctor’s association to file a lawsuit against ObamaCare, is that it’s mission is to restore the doctor-patient relationship.

One of our doctors is Keith Smith, an anesthesiologist and owner of the Surgical Center of Oklahoma who is becoming a celebrity for rewriting the business model for medical delivery. Ironically, he and his partners are going back to the way things once were. By simplifying the delivery, posting the rates online, eliminating third-party payers and the extravagant and wasteful overhead of hospital administration, patients can receive medical procedures at a fraction of the cost, even less than what Medicare charges.

In one instance, a patient priced a surgery at $40,000 in a local hospital, but the surgical center was able to provide that same surgery for under $4,000.

It’s a game-changer and is causing local hospitals to take notice, and even drop their own prices. The free market is resilient because doctors are taking responsibility for their own future and their patient’s well-being and finding great opportunity.
